If you want your wife, husband or partner to come and join you in the UK, they will need to apply for a spouse visa application. This Spouse visa category is for partners of British citizens, persons with indefinite leave to remain, refugee status or limited leave to remain under Appendix EU or Appendix ECAA of the Immigration Rules.
Check How Much You Must be Earning
In order to demonstrate that you can be adequately maintained in the UK without recourse to public funds, you will need to satisfy a financial requirement.
The financial requirement for a UK Spouse visa application states that you will need to demonstrate that your Spouse (or both of you jointly if you are in the UK with valid leave to remain) has a gross annual income of at least:
£18,600; plus
£3,800 for a first child (who is not British, settled or an EEA national); plus
£2,400 for each additional child (who is not British, settled or an EEA national).
Living in the UK To Apply for the Visa
- If you live in the UK under a skilled worker visa, your partner will need to apply as a dependent Tier 2 (General) visa holder on the UK government website.
- If you live in the UK under a Tier 4 Student visa, your partner will be required to apply as a dependent of the student visa holder on the UK government site.
- The rules are different depending on the category type, one of the requirements will be to ensure you have sufficient funds and prove that your relationship is genuine.
- It is important to make sure you consult with an immigration professional such as My Legal Services if you have any questions regarding your Spouse’s visa or different partner’s visa for them to come and join you in the UK.
Your partner will also be able to apply from outside the UK, and they can apply from inside the UK as long as:
- They were permitted leave to remain in the UK for more than six months
- They are not in the UK on a visit visa
- The visa category allows them to switch and apply from inside the UK
- If the original visa were less or equal to 6 months, your partner would not be allowed to switch to a spouse visa while they are in the UK. They need to leave the UK and apply to enter again as a spouse or partner.
